Chaim, can you help me with a question? I understand why Jews were quick on the trigger with the surrendered Nazis. But Jews are commanded not to kill the murderer before he stands trial in Numbers 35:12.

Does Jewish law differentiate between regular murderers and descendants of Amalek?

A war is not like a judicial proceeding against an accused criminal. In a war, there are no trials. In a war, the enemy is killed before he kills you. That is especially true in the war against Amalek, which is all those who seek to exterminate the Jewish people. Amalek is not today a physical nation as far as we know. But all those who attack Israel and the Jews are adopting the ideology of Amalek and must be treated like Amalek.

I am sure that's true for Jews. I need a source that a Gentile can kill someone who surrenders on the spot. If he surrenders, it seems unnecessarily cruel to kill him without a trial.
